These Terms of Service ("Terms") govern access to and use of the rank-with-ai.com website and the associated online service (the "Service"), published by FRAN AESTHETICS LTD, a Private Limited Company (Ltd) under English law with share capital of £1, registered at Companies House (Cardiff) under company number 16227741, with registered office at 46 Station Road, Bordon, GU35 0GE, United Kingdom (hereinafter "RankWithAI" or "we").
Use of the Service implies your full and unreserved acceptance of these Terms (hereinafter "you" or the "Customer").
1. Description of the Service
RankWithAI is a SaaS platform that allows businesses, agencies, and professionals to track, analyze, and optimize their visibility in AI-powered search engines (notably ChatGPT, Perplexity, Google AI Overviews, Gemini, Claude). The Service includes in particular:
- Brand-mention tracking in AI-generated responses
- Position analysis by keyword and prompt
- Competitive tracking
- Generation of reports and dashboards
- GEO (Generative Engine Optimization) of your online presence
2. Acceptance and modification of the Terms
Registration for the Service constitutes unreserved acceptance of these Terms. We reserve the right to modify the Terms at any time. Material changes will be notified to you by email at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.
3. User account
3.1 Creation
Creating an account requires accurate, up-to-date, and complete information. You are responsible for the confidentiality of your credentials and for all activity carried out from your account.
3.2 Eligibility
The Service is intended for businesses, freelancers, and agencies, or adult individuals with the legal capacity to enter into a contract. You must be at least 18 years old to use the Service.
3.3 Suspension and termination by us
We may suspend or close your account without notice in case of breach of these Terms, fraudulent use, or non-payment.
4. Pricing, subscriptions, and payment
4.1 Pricing
Prices in force are listed on the pricing page of the site. They are expressed in US dollars (USD), inclusive of all applicable taxes unless otherwise stated.
4.2 Subscriptions
The Service is offered as monthly subscriptions ($99/month) or annual subscriptions ($990/year) with automatic renewal. The initial commitment period and renewal terms are specified at checkout.
4.3 Trial period
A 7-day introductory access is offered at $9. At the end of the trial period, the subscription automatically continues at the standard rate ($99/month or $990/year) unless canceled before the end of the trial.
4.4 Payment terms
Payment is processed by credit card via our payment processor Stripe. Payments are charged in advance for the subscription period purchased.
4.5 Payment default
In case of payment failure, access to the Service may be suspended after 7 days' notice.
4.6 Price changes
We may change subscription prices subject to 30 days' notice by email. Continued use of the Service after the effective date constitutes acceptance of the new pricing.
5. Cancellation and refund policy
You may cancel your subscription at any time from your Stripe customer portal. Cancellation takes effect at the end of the current billing period. No pro-rata refund is granted for the unused portion of a period already paid, except where required by applicable law.
60-day money-back guarantee: If your business is not cited by ChatGPT, Gemini, Perplexity or Google AI Overviews within 60 days of your subscription start date, you may request a full refund by contacting [email protected]. This guarantee applies to customers who have completed their GEO onboarding and provided accurate business information.
All GEO optimizations already applied to your online presence remain yours after cancellation.
6. Availability and maintenance
We commit to deliver the Service with a target availability of 99% on a monthly basis, excluding scheduled maintenance, force majeure, and failures of third-party providers (notably the AI engines' APIs). The Service carries no obligation of result regarding the accuracy or completeness of data returned by third-party AI engines, which evolve independently.
7. Customer obligations
You undertake to:
- Use the Service for its intended purpose and in compliance with applicable laws
- Not attempt to bypass technical limits (rate limiting, quotas)
- Not perform mass data extraction (scraping, reverse engineering)
- Not resell or sublicense access to the Service to third parties
- Provide accurate business information to enable effective GEO optimization
Any breach may result in immediate suspension of the account without refund.
8. Intellectual property
8.1 Our property
The Service, its trademarks, code, interfaces, databases, editorial content, and analytical methodologies are the exclusive property of FRAN AESTHETICS LTD and protected by copyright and intellectual property law. A personal, non-exclusive, non-transferable, revocable license to use the Service is granted to you for the duration of your subscription.
8.2 Your content
The data you enter into the Service (brands, keywords, prompts, business information, etc.) remains your property. You grant us a non-exclusive license to use it strictly as needed to deliver the Service.
8.3 Reports and generated data
Reports and analyses generated via the Service are licensed to you for internal business use.
9. Personal data
The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms. For US residents, please refer to the CCPA/CPRA section of the Privacy Policy.
10. Limitation of liability
To the fullest extent permitted by applicable law, our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount actually paid by you over the 12 months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of customers, loss of data, or reputational harm.
AI engine responses may contain inaccurate or incomplete information. We do not warrant the accuracy of data returned by third-party AI engines. You are responsible for verifying information before making any business decision.
11. Termination
11.1 By you
You may terminate your subscription at any time from your customer portal. Termination takes effect at the end of the current billing period.
11.2 By us
We may terminate your subscription with 30 days' notice, or without notice in case of material breach on your part.
11.3 Effect of termination
Upon termination, your account is deactivated. Your data is retained for 90 days for potential recovery, then permanently deleted, subject to legal retention obligations.
12. Governing law and dispute resolution
These Terms are governed by the laws of England and Wales. Any dispute shall first be subject to good-faith negotiation. Failing resolution, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws of your country of residence apply.
For US customers: to the extent permitted by law, you waive any right to a jury trial and agree that any dispute will be resolved on an individual basis (no class actions).
13. Miscellaneous
Severability: the invalidity of one clause does not affect the other provisions.
No waiver: our failure to enforce any clause does not constitute a waiver of that right.
Assignment: we may assign these Terms in case of reorganization, merger, or transfer of business.
Entire agreement: these Terms, together with the Privacy Policy and any order confirmation, constitute the entire agreement between you and RankWithAI regarding the Service.
